Netherstowe House Booking Terms & Conditions

In order to avoid any misunderstandings regarding reservations, the following are our terms & conditions of trading. For reservations of 7 days or more please contact our reservation desk for terms and conditions. Once you have booked your stay, our agreement is a legal contract.

Our reservations team are pleased to advise you of the availability and prices of rooms and apartments on the dates you require and will be pleased to give you any other information. All reservations must be confirmed by email from our Reservations Manager. No reservation can be accepted as binding on the Company, unless accompanied by full payment. A £2.50 credit card charge is levied on all bookings. Debit card bookings have no fee. Failure to provide payment shall deem the reservation to have been cancelled. In exceptional / necessary circumstances, Netherstowe House reserves the right to offer an alternative room or apartment, date of stay or cancel reservation(s) to the payee. No refund will be given for early departure.

In the unfortunate event that you have to cancel or postpone your confirmed booking a full refund will be given if cancellation is notified more than 48 hours prior to your arrival date. If less than 48 hours 50% of the total reservation cost will be refunded. All cancellations must be made in writing by email. The date of arrival of the written email cancellation notice at Netherstowe House will be the accepted date for commencement of the cancellation notice period.

Gift Vouchers
Please ensure that you bring your redeemable gift voucher to Netherstowe House to present on arrival. Non presentation of Voucher may necessitate in a charge being made until the voucher is presented. If full or part payment of your visit is by Gift Voucher, this will become void if you fail to arrive.

Your bedroom / apartment accommodation will be available from 12midday onwards on the day of arrival.

We advise that you take Insurance cover to avoid cancellation costs being incurred.

Guests with confirmed reservations who do not take up the reservation will be considered as non-arrivals and will therefore be liable for the applicable room charge in full. In case of voucher bookings, the voucher will be forfeited.

All accommodation rates quoted are inclusive of VAT. Extra services will be charged at the rates shown at the premises. Pre-booked additional services will be charged at the rate current on the date of booking.

Children and Pets
Children of all ages can be accommodated in the Serviced Apartments and travel cots can be provided upon request subject to availability. Children over 12 years can also be accommodated in the main house. We regret that we cannot allow guests to bring pets, but boarding kennels are available locally.

No responsibility can be accepted by Netherstowe House for the safety of money or valuables of any kind brought to Netherstowe House. If you do bring valuable items, it is essential that they are covered by your own insurance for the period of your stay. Netherstowe House, will not be liable, under any circumstances whatsoever, for damage, injury or consequential loss, however caused, to our residents, their property and belongings.

Netherstowe House is totally non-smoking and for the benefit of future guests, we reserve the right to charge £125.00 to deep clean rooms / apartments where smoking has occurred.

Alcohol Consumption
Netherstowe House operates a policy of providing alcohol, with controls, to resident guests throughout the complex and to non-resident guests, in its dining areas, as an accompaniment to meals. This is in line with current health advice on alcohol unit consumption. It is requested that guests do not bring alcohol onto the premises for consumption in bedrooms or apartments. On safety grounds, alcohol consumption affects an individual’s safe use of the hotel’s facilities and the receiving of treatments with the consequence of dangerous side effects. We aim at all times to preserve the peace and tranquillity for all guests within the complex. A ‘low tolerance policy’ is applied to individuals who cause a nuisance and disturbance through not respecting our policy on alcohol.

On day of departure, guests are requested to vacate bedrooms and apartments no later than 10:30am to enable us to prepare the accommodation for arriving guests. However, if you would like us to store luggage on site just let us know and we will be delighted to do so.

Mechanical / Electrical Breakdowns
Any mechanical or electrical breakdowns which occur on the premises are usually beyond our control, although we will try to repair any such fault as soon as possible, No refunds will be given unless any such breakdown is due to negligence of the Company or its employees.

1 Agreement
This Agreement is made between Lont Properties Limited whose Registered Office is at The Tithe Barn, Deans Lade Farm, Claypit Lane, Lichfield, Staffordshire, WS14 0GA
1.1 Definitions and interpretation
For all purposes in this agreement the terms defined in this clause shall have the meanings specified

2 “The Company”
The Company means Lont Properties Limited
2.1 “The Furniture and Furnishings”
“The Furniture and Furnishings” means the furniture and furnishings used by the Applicant from time to time in the Apartment, and provided by Lont Properties Limited
2.2 “The House”
“The House” means the owner’s property known as Netherstowe House, Netherstowe Lane, Lichfield, Staffordshire WS13 6AY
2.3 “The Room”
“The Room” means the rooms in the House that are from time to time allotted to the Applicant by the Company and which room initially is the room described on the Applicants booking confirmation.

3. Nature of this agreement
This agreement is not intended to confer exclusive possession on the Applicant nor to create the relationship of landlord and tenant between the parties. The Applicant shall not be entitled to a tenancy, or to an assured shorthold or assured tenancy, or to any statutory protection under the Housing Act 1988 or to any other statutory security of tenure now or upon the determination of the Licence

4 Licence to occupy
The Company permits the Applicant to occupy the Room or share the occupation of the Room with such person or persons the Company may approve occupation being by the Applicant personally and such person or persons only, and to use the Furniture and Furnishings upon the terms set out in this booking form

5 Keys
5.1 The Company will issue to the Applicant one key to the Room and the House
5.2 If the Applicant loses a key then the Applicant shall pay to the Company £45 for each replacement key provided by the Company
5.3 The Company shall retain its own key to the Room and it and any persons authorised by it, including other grantees of the use of the Room, may exercise the right to use the key and obtain free entry to the Room at any time

6 Access and use of facilities
The Applicant shall have the right to use the front door, entrance hall, staircase, and the landings of the House and to use the gymnasium in the basement of Netherstowe House Mews in a reasonable manner and at the Applicant’s own risk for exercise in common with the Company and the other licensees of the Company. Thegymnasium is unsupervised and is used at the Applicant's own risk. The minimum age for unsupervised gymnasium use is 18 years old. 13-17 year olds may use the gymnasium if they are accompanied by an appropriate adult. You may not use this gymnasium if you are under the age of 13. For health and safety reasons, the Applicant will ensure that they are wearing suitable clothing and trainers when using the gymnasium. Please be advised that there are risks inherent in participating in any exercise. Furthermore, not all exercise is suitable for everyone. Extreme care must therefore be taken in selecting and using exercise equipment. It is the Appicant's responsibility to ensure that they fully understand how to use any exercise equipment that they use and only perform exercises that are within their capabilities and are appropriate to their state of health and level of fitness. To reduce the risk of injury the Applicant will consult their doctor or another suitable medical professional before using the gymnasium or beginning any exercise program. If the Applicant has not previously used gymnasium equipment, have injuries, are pregnant, had a joint replacement, have osteoporosis or any other special medical condition, then particular care is warranted and they must consult their doctor or take medical advice before using the gymnasium and follow all relevant precautions. By using the gymnasium the Applicant assume the risk of injury or illness resulting from such use and, in particular, from performing exercises or using the gym equipment. The Company, its owners, management, employees, agents and/or contractors shall not under any circumstances be liable, whether in contract or tort (including negligence), for breach of statutory duty, or otherwise, for any injury, illness, harm, loss or damage whatsoever, that the Applicant might suffer as a result of using the gymnasium. Nothing in these Terms of Use shall limit or exclude any liability of The Company or any other party for (i) death or personal injury caused by its negligence, or the negligence of its owners, management, employees, agents or contractors. or (ii) any other liability that cannot be excluded by law. Except as set out in these Terms of Use, all warranties, conditions and other terms implied by statute or common law are excluded to the fullest extent permitted by law.

7. Furniture and Furnishings
7.1 The Applicant must keep the Furniture and Furnishings in good order and condition and must not remove any of them from the Room. The Applicant must make good any damage to the Furniture and Furnishings caused by the Applicant or the Applicant’s invitees and replace with articles of a similar kind and value any items broken or damaged by him or them, as reasonably requested by the Company
7.2 The Company confirms that the Furniture and Furnishings comply with the Furniture and Furnishings (Fire Safety) Regulations 1988 as amended

8. Rubbish
The Applicant must ensure that all rubbish is disposed of daily and placed in the rubbish bin provided by the Company

9. Services
9.1 The Company must provide the services for the Applicant in respect of the Room set out in
9.2 The Company confirms that it has complied with the Gas Safety (Installation and Use) Regulations 1998 and the safety certificate is available for inspection by the Applicant

10. Determination
The Agreement may be determined:
10.1 by the Company giving to the Applicant not less than twenty four hours (24hours) notice period
10.2 in respect of the occupation of any particular Apartment in the House, by the Company giving written notice directing the Applicant to use another room or apartment at Netherstowe House Mews instead subject to the Applicant having 24 hours to remove his personal effects to the substituted room or apartment
10.3. by the Company forthwith if the Applicant is in breach of any condition of this agreement but without prejudice to any other remedies of the Company in respect of the breach

11 Vacation of the Apartment
Upon determination of the Agreement, the Applicant shall immediately cease to be entitled to use the Room and the House and must vacate the Room, leaving it clean and tidy, and return the key to the Company immediately

12 Liability
The Company do not accept any liability for any damage, loss or injury to the Applicant or any vehicles or possessions

13 Data
Any data gathered during the course of the Applicants booking may be held on computer by the Company

14 Acknowledgements
14.1 This agreement embodies the entire understanding of the parties relating to the Apartment and the House and to all the matters dealt with by any of the provisions of this agreement
14.2 In particular and without prejudice to the generality of the foregoing the Applicant acknowledges that he has received a copy of this agreement and has had the opportunity of taking legal advice on it and has read and understood it, and acknowledges that the Room and all parts of the House will be shared with the Company and other persons to whom the Company grants a licence and that he will not have exclusive possession of the Room or any part of the House under any circumstances.
